Penalties for Sexual Assault
Per Texas Penal Code § 21.011, one would be guilty of sexual assault if they intentionally and knowingly penetrated another person's mouth or sexual organ without their consent and/or engaged in sexual contact with another person without their consent.
In order to prove that the victim had failed to provide consent, however, the prosecution must be able to establish that:
- The offender compelled the victim through the use of force
- The offender compelled the victim through the threat of force
- The victim was unconscious or physically unable to resist
- The victim was not capable of consenting due to mental disease or defect
- The victim was unaware that the assault was occurring
- The offender threatened to use force against another person
- The offender was a public servant who coerced the victim
If the prosecution is successful in proving that one or more of the aforementioned circumstances existed at the time of the assault, the defendant could be convicted of a felony in the second degree. This sex crime is punishable by a term of imprisonment for no less than 2 years but no longer than 20. The offender may also be required to register themselves as a sexual offender upon their release.
